Night Gear Solutions (PRIMANOX s.r.o.) realizuje prostredníctvom svojich účtov na sociálnych sieťach súťaže o vecné ceny, ktoré do súťaží bezodplatne poskytujú tretie strany. Organizátorom súťaží je spoločnosť  PRIMANOX s.r.o. , Kalinčiakova 6206/2, 974 05 Banská Bystrica, IČO:  53324048 , zapísaná v OR OS Banská Bystrica, oddiel: Sro, vložka č. 40894/S

Súťaže sú realizované na území Európskej únie prostredníctvom jednotlivých príspevkov uverejnených na

po vymedzený čas, ktorý je jasne a viditeľne uvedený v rámci konkrétneho príspevku obsahujúceho súťaž.

 

Sociálne siete Facebook a Instagram a  ich prevádzkovatelia nemajú voči organizovaným súťažiam žiadne záväzky. Súťaže nimi nie sú žiadnym spôsobom sponzorované, schválené či organizované a nemajú na ne žiadne prepojenie.

Účastníkom súťaže sa stáva fyzická osoba spĺňajúca podmienky registrácie na sociálnych sieťach Facebook a Instagram, ktorá v čase konania súťaže napíše komentár pod uverejnený súťažný príspevok na sociálnych sieťach Facebook a Instagram, prípadne splní ďalšie podmienky uverejnené v čase publikovania príspevku v rámci neho, pričom tieto vždy spĺňajú pravidlá súťaží realizovaných na uvedených sociálnych sieťach.

Osoby mladšie ako 18 rokov musia mať na účasť v súťaži súhlas zákonného zástupcu. Výhercom sa môže stať iba účastník s doručovacou adresou na území Európskej únie.

Súťaže sa nemôžu zúčastniť právnické osoby a zamestnanci organizátora, ani osoby im blízke v zmysle §116 zákona č. 40/1964 Zb., v znení neskorších predpisov (Občiansky zákonník).

Vzhľadom na skutočnosť, že súčasťou súťaže môžu byť autorské diela súťažiacich, udeľuje týmto každý účastník súhlas s úpravami a akýmkoľvek užitím diela podľa ustanovenia Autorského zákona v platnom znení, diela alebo jeho častí organizátorom pre marketingové účely spojené s touto súťažou a s ďalšou propagáciou organizátora, a to zadarmo, neobmedzene časom i miestom. Ďalej účastník zapojením sa do súťaže berie na vedomie a záväzne prehlasuje, že autorské dielo v podobe fotografie, ktorú pridá do súťaže je jeho dielom a/alebo má od autora a všetkých osôb s týmto dielom spojených súhlas s použitím v rámci tejto Súťaže aj po Súťaži a podľa pravidiel tejto súťaže.

Účastník súťaže sa zaväzuje, že použitím súťažného príspevku nebudú dotknuté akékoľvek práva tretích osôb, vrátane práv osôb zobrazených v súťažnom príspevku. Všetky nutné súhlasy súvisiace s použitím súťažného príspevku v tejto súťaži si musí účastník súťaže vysporiadať na vlastné náklady a vlastnú zodpovednosť. Za prípadné porušenie práv tretích osôb, najmä práv autorských či osobnostných v súvislosti so súťažným príspevkom, je zodpovedný účastník súťaže. V prípade ďalšej potreby použitia takéhoto diela organizátorom, nad rámec vyššie uvedený v týchto pravidlách) účastník súťaže potvrdzuje, že v nadväznosti na vznesenú požiadavku organizátora písomne potvrdí právo použitia predmetného autorského diela organizátorom, pokiaľ s takýmto použitím bude súhlasiť. Súťažiaci však nie je povinný s použitím podľa predchádzajúcej vety súhlasiť. Za toto použitie súťažiacemu neprináleží žiadna dodatočná finančná či nefinančná odmena alebo protiplnenie.

Výherca alebo výhercovia budú vybraní určeným zástupcom organizátora alebo porotou určenou zástupcami organizátora, a to na základe splnenia stanovených pravidiel. Výherca bude o svojej výhre informovaný najneskôr do siedmich dní od termínu ukončenia súťaže uvedeného pri konkrétnom príspevku, a to komentárom pod súťažným príspevkom (komentárom), ktorý bol vybraný za výherný a v ktorom bude užívateľ označený svojim užívateľským menom.

Organizátor súťaže neuchováva žiadne osobné údaje účastníkov súťaží s výnimkou výhercov. Každý účastník preto svojou účasťou v súťaži udeľuje súhlas k tomu, že jeho osobné údaje v rozsahu, v akom sú prístupné verejnosti na sociálnej sieti Facebook alebo Instagram, na ktorej sa účastník zapojil do súťaže, môžu byť použité primeraným spôsobom v marketingovej komunikácii organizátora v súvislosti s konkrétnou súťažou.

Výherca dostane inštrukciu o kontaktovaní organizátora, ktorý následne výhercovi poskytne informáciu o možnosti osobného prevzatia výhry u tretej strany, ktorá poskytuje výhry do súťaže alebo sa vzájomne dohodnú na zaslaní vecnej ceny na adresu výhercu, pričom organizátor takýto údaj získaný prostredníctvom komunikácie na sociálnej sieti využije výlučne na vykonanie odovzdania výhry a následne tieto údaje ďalej neuchováva.

Účastník súťaže preto svojou účasťou v súťaži a súhlasom s týmito podmienkami udeľuje súhlas, že v prípade výhry v súťaži, bude môcť organizátor použiť osobné údaje účastníka v rozsahu meno, priezvisko, adresa (ulica, číslo popisné, mesto/obec a PSČ) a e-mail za účelom doručenia výhry.

Každý účastník má právo na informácie o stave spracúvania svojich osobných údajov, ktoré sú predmetom spracúvania, právo na opravu nesprávnych alebo neaktuálnych osobných údajov v priebehu spracúvania, právo na likvidáciu osobných údajov, ak bol splnený účel ich spracúvania, právo na základe bezplatnej písomnej žiadosti namietať voči využívaniu svojich osobných údajov na marketingové účely.

V prípade, že sa nepodarí s výhercom skontaktovať do 14 dní od uskutočnenia žrebovania, bude vyžrebovaný nový výherca. Organizátor si vyhradzuje právo konečného rozhodnutia, či podmienky stanovené pre danú cenu boli splnené alebo nie. Ceny nemôže vyhrať súťažiaci, ktorý nesplnil, aj keď iba čiastočne, podmienky stanovené pre výhru ceny. Ak Výherca neprejaví súhlas s nadobudnutím výhry, vzdá sa výhry, odoprie súhlas, resp. nesplní inú podmienku podľa týchto pravidiel, výhru získava novovyžrebovaný náhradník.

Účastník súťaže súhlasí, že organizátor nebude zodpovedať za dane vyplývajúce z výhry podľa príslušného zákona č. 595/2003 Z.z. o dani z príjmov v znení neskorších predpisov.

Organizátor si vyhradzuje právo na zmenu pravidiel súťaže, na zrušenie súťaže, dĺžku trvania ako aj podmienky súťaže, najmä, ale nie výlučne, pravidlá žrebovania, dátum uskutočnenia žrebovania, počet výhercov, ako aj druhy výhier, ktoré budú predmetom žrebovania. Zmenu pravidiel a podmienok súťaže organizátor vhodným spôsobom zverejní. Organizátor nezodpovedá za žiadne škody vzniknuté v súvislosti s nesprávnymi údajmi poskytnutými Účastníkmi Súťaže v súvislosti s neuplatnením, resp. nevyužitím výhry.

Výherca nemá právny nárok na výmenu výhry alebo výplatu jej hodnoty formou peňažnej alebo inej kompenzácie.

Účastník hry berie na vedomie, že výhru nie je možné vymáhať súdnou cestou. V prípade akéhokoľvek sporu týkajúceho sa Súťaže, bude rozhodnutie organizátora konečné a záväzné. Na výhru sa nevzťahujú ustanovenia § 612 až 627 Občianskeho zákonníka v znení neskorších predpisov. Účastníci súťaže sa môžu s týmito pravidlami oboznámiť na stránke pravidiel súťaží.

Zapojením sa do súťaže vyjadrujú účastníci súťaže svoj súhlas spravovať sa týmito pravidlami.

The social networks Facebook and Instagram and their operators have no obligations towards organized competitions. The competitions are in no way sponsored, approved or organized by them and have no connection to them.

 

A natural person who meets the conditions for registration on the social networks Facebook and Instagram becomes a participant in the competition, who, at the time of the competition, writes a comment under the published competition post on the social networks Facebook and Instagram, or fulfills other conditions published at the time of publication of the post within it, while these always they comply with the rules of contests implemented on the mentioned social networks.

Persons under the age of 18 must have the consent of a legal representative to participate in the competition. Only a participant with a delivery address in the territory of the European Union can become a winner.

Legal entities and employees of the organizer, as well as persons close to them, pursuant to §116 of Act no. 40/1964 Coll., as amended (Civil Code).

Due to the fact that the competition may include the contestants' works of authorship, each participant hereby grants consent to the modifications and any use of the work in accordance with the provisions of the Copyright Act as amended, of the work or its parts by the organizer for marketing purposes connected with this competition and with the organizer's further promotion, and it's free, unlimited by time and place. Furthermore, by participating in the competition, the participant acknowledges and bindingly declares that the author's work in the form of a photograph that he adds to the competition is his work and/or has the consent of the author and all persons associated with this work to be used within this Competition and after the Competition and according to the rules of this competition.

 

The contest participant undertakes that the use of the contest entry will not affect any rights of third parties, including the rights of the persons shown in the contest entry. All necessary approvals related to the use of the competition contribution in this competition must be settled by the competition participant at his own expense and responsibility. The participant of the competition is responsible for any violation of the rights of third parties, especially copyright or personality rights in connection with the competition entry. In case of further need for the use of such a work by the organizer, beyond the scope mentioned above in these rules), the participant of the competition confirms that, following the request made by the organizer, he will confirm in writing the right to use the author's work in question by the organizer, as long as he agrees to such use. However, the competitor is not obliged to agree to the use according to the previous sentence. The contestant is not entitled to any additional financial or non-financial reward or compensation for this use.

The winner or winners will be selected by a designated representative of the organizer or a jury designated by the organizer's representatives, based on compliance with the established rules. The winner will be informed of his win no later than seven days from the end date of the competition specified for a specific entry, by commenting under the competition entry (comment) that was selected as the winning entry and in which the user will be marked with his username.

 

The organizer of the competition does not store any personal data of the participants of the competitions, with the exception of the winners. Therefore, by participating in the competition, each participant gives their consent to the fact that their personal data, to the extent that it is accessible to the public on the social network Facebook or Instagram, on which the participant participated in the competition, can be used in an appropriate way in the marketing communication of the organizer in connection with with a specific competition.

The winner will receive instructions to contact the organizer, who will then provide the winner with information about the possibility of receiving the prize in person from a third party that provides prizes for the competition, or they will mutually agree on sending the physical prize to the winner's address, while the organizer will use such information obtained through communication on the social network exclusively to carry out the delivery of the prize and subsequently does not store this data.

Therefore, by participating in the competition and agreeing to these conditions, the participant of the competition gives consent that in the event of winning the competition, the organizer will be able to use the personal data of the participant in the scope of name, surname, address (street, identification number, city/town and zip code) and e - email for the purpose of delivery of the prize.

Each participant has the right to information about the processing status of their personal data that is the subject of processing, the right to correct incorrect or out-of-date personal data during processing, the right to dispose of personal data if the purpose of their processing has been fulfilled, the right to object based on a free written request against the use of your personal data for marketing purposes.

 

If the winner cannot be contacted within 14 days of the draw, a new winner will be drawn. The organizer reserves the right to make the final decision whether the conditions set for the given prize have been met or not. Prizes cannot be won by a competitor who has not met, even partially, the conditions set for winning a prize. If the Winner does not express his consent to the acquisition of the prize, he will give up the prize, refuse to consent, or does not fulfill another condition according to these rules, the prize goes to the newly drawn substitute.

The participant of the competition agrees that the organizer will not be responsible for the taxes resulting from the winnings according to the relevant Act no. 595/2003 Coll. on income tax as amended.

The organizer reserves the right to change the rules of the competition, to cancel the competition, the duration and conditions of the competition, in particular, but not exclusively, the rules of the draw, the date of the draw, the number of winners, as well as the types of prizes that will be the subject of the draw. The organizer will publish the change in the rules and conditions of the competition in an appropriate way. The organizer is not responsible for any damages incurred in connection with incorrect data provided by Contest Participants in connection with non-application, or by not using the winnings.

 

The winner has no legal right to exchange the prize or pay its value in the form of monetary or other compensation.

The participant of the game acknowledges that the winnings cannot be claimed through the courts. In case of any dispute regarding the Competition, the decision of the organizer will be final and binding. The provisions of Sections 612 to 627 of the Civil Code, as amended, do not apply to the prize. Contest participants can familiarize themselves with these rules on the contest rules page.

By participating in the competition, participants express their consent to be governed by these rules.
